Terms of Service

Welcome to Reframer ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Reframer iOS app, Apple Watch companion app, Mac app, website, and related services (collectively, the "Service").

By downloading, accessing, or using Reframer, you agree to be legally bound by these Terms. If you do not agree to all of these Terms, you must not access or use the Service.

1. Medical, Clinical, and Crisis Disclaimer (Assumption of Risk)

A. Reframer Is Not a Medical or Healthcare Services Provider

REFRAMER IS A SELF-HELP AND SELF-REFLECTION TOOL BASED ON COGNITIVE BEHAVIORAL THERAPY (CBT) PRINCIPLES AND HIGHLY TUNED ARTIFICIAL INTELLIGENCE (AI). IT IS NOT A CLINICAL, MEDICAL, PSYCHIATRIC, OR CRISIS INTERVENTION SERVICE.

• The Service does not contain or provide medical, psychiatric, or clinical advice, diagnosis, treatment, or care.
• Nothing in the App or generated by its AI models should be considered as clinical or professional psychological advice.
• The Service is not a substitute for care provided by a licensed doctor, therapist, psychiatrist, or qualified healthcare professional. Never disregard or delay seeking professional medical advice because of something you read or generated within Reframer.

B. Passive Crisis Screening & Directory Disclaimer

• Reframer utilizes passive, automated tools (including on-device keyword scanning and backend AI pre-screening) and an offline-capable directory of global helplines to assist you in finding support.
• The Service does not actively monitor, track, or review your entries for active life-safety emergencies in real-time, and we cannot dispatch emergency services to your location.
• Automated safety screening may fail, produce false negatives, or experience technical errors. You agree that we bear no liability for any failure, delay, or inaccuracy in detecting crisis inputs or providing helpline information.
• IF YOU ARE IN CRISIS, THINKING OF SELF-HARM OR SUICIDE, OR EXPERIENCING A MEDICAL EMERGENCY, IMMEDIATELY CALL YOUR LOCAL EMERGENCY SERVICES (E.G., 911 IN THE US, 999 IN THE UK, 112 IN EUROPE) OR GO TO THE NEAREST HOSPITAL EMERGENCY ROOM.

2. AI Technology, Output Disclaimers, and Third-Party Infrastructure

A. Probabilistic AI & Hallucinations

Reframer integrates third-party Artificial Intelligence sub-processors (such as Anthropic's Claude API) routed through secure cloud infrastructure (Supabase) to generate reframes and process entries. You acknowledge and agree that:

• While we continue to fine-tune our AI Agents at the backend, AI algorithms are inherently probabilistic and non-deterministic. AI-generated reframes, suggestions, and insights may be inaccurate, inappropriate, incomplete, or unhelpful.
• You are solely responsible for evaluating, interpreting, and acting upon any AI outputs or suggested micro-actions. You use all AI-generated content at your own risk.

B. Service Outages & On-Device Fallback

While Reframer features an on-device pattern matching fallback when no network connection is present, online features depend on third-party cloud and AI providers. We do not guarantee uninterrupted, error-free, or 100% continuous uptime of our third-party infrastructure (including Supabase, Anthropic, or Cloudflare APIs).

3. Eligibility, Accounts, and Device Security

• Age Limit: You must be at least 13 years old (or the legal minimum age of digital consent in your jurisdiction, e.g., 16 in certain EU countries) to use Reframer.
• Account Types: You may use the App as an unauthenticated guest ("Guest Mode") or register via Apple ID or email. If you create an account, you are responsible for maintaining the confidentiality of your credentials.
• Local Device Security: While Reframer supports biometrics (Face ID / Touch ID Secure Enclave) and local PIN locking, you are solely responsible for securing your physical Apple devices against unauthorized access.

4. User Content, Intellectual Property, and Privacy

• Ownership of User Content: You retain full ownership of all text, thoughts, mood entries, and inputs you submit to the Service ("User Content").
• Limited Processing License: You grant us a non-exclusive, worldwide, royalty-free license to process, transmit, and store your User Content solely for the purpose of operating, maintaining, and providing the Service to you (e.g., transmitting encrypted payload data (excluding your personal information — Name, Email, Age, etc.) to our AI sub-processors to generate reframes).
• Zero AI Model Training Guarantee: Pursuant to our commercial API agreements, your User Content is never used to train foundational AI models.
• Encryption & Data Handling: User data is encrypted in transit using TLS/HTTPS and at rest at the database infrastructure level. Full details regarding data collection, processing, and retention are provided in our Privacy Policy.
• Our Intellectual Property: Except for your User Content, all app design, copy, interface assets, graphics, code, safety screening algorithms, and proprietary prompts are our exclusive property and are protected under international copyright, trademark, and trade secret laws.

5. Subscriptions, Payments, and Refunds

• App Store Billing: Subscriptions, in-app purchases, or premium tier access (Plus and Pro) are billed through the Apple App Store. All billing, currency conversions, and payment processing are governed by Apple's standard terms.
• Cancellations & Refunds: Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date via your Apple ID settings. Because payments are handled directly by Apple, all requests for refunds must be submitted directly to Apple Customer Support.

6. Prohibited Conduct and Acceptable Use

You agree not to engage in any of the following prohibited activities:

• Attempting to reverse engineer, decompile, extract source code, or harvest the underlying prompts, system parameters, or safety algorithms of the App.
• Using automated scrapers, bots, or scripts to monitor, extract, or overload the App's APIs or infrastructure.
• Utilizing the Service to store, process, or transmit illegal, harassing, violent, abusive, or harmful material.
• Reselling, redistributing, or exploiting the App or its AI outputs for unauthorized commercial purposes.

We reserve the right to suspend or permanently terminate your account or access to the Service without notice if you breach these Terms.

7. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ENTIRELY ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, BUG-FREE, ACCURATE, COMPLETELY SECURE, OR FREE FROM VIRUSES OR HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL REFRAMER, ITS DEVELOPERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, OR THIRD-PARTY SUB-PROCESSORS (INCLUDING ANTHROPIC AND SUPABASE) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, DATA LOSS, PERSONAL INJURY, EMOTIONAL DISTRESS, MEDICAL EXPENSES, WORK STOPPAGE, OR HARDWARE FAILURE ARISING OUT OF OR IN CONNECTION WITH:

1. YOUR USE OF OR INABILITY TO USE THE SERVICE;
2. ANY RELIANCE PLACED BY YOU ON AI-GENERATED REFRAMES, INSIGHTS, OR CRISIS HELPLINE DIRECTORIES;
3. UNAUTHORIZED ACCESS, BREACH, OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; OR
4. ANY ACTIONS OR STATEMENTS OF ANY THIRD PARTY ON OR THROUGH THE SERVICE.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50.00 USD), WHICHEVER IS GREATER.

(Note: Some jurisdictions, such as the EU, UK, Canada, or US states, do not allow certain limitations of liability or disclaimers of statutory rights. In such jurisdictions, our liability shall be limited to the minimum extent permitted by applicable law.)

9. Indemnification

You agree to defend, indemnify, and hold harmless Reframer, its developers, officers, directors, employees, and third-party partners from and against any claims, liabilities, damages, losses, expenses, or legal fees (including reasonable attorneys' fees) arising out of or related to:

• Your breach or violation of these Terms;
• Your User Content or reliance on AI outputs generated by the Service; or
• Your violation of any rights of a third party or applicable local laws.

10. Dispute Resolution, Governing Law, and Arbitration

• Governing Law: These Terms and any disputes arising out of or related to the Service shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.
• Informal Resolution: Before filing a formal legal claim, you agree to contact us at legal@reframer-app.com and attempt to resolve the dispute informally for at least thirty (30) days.
• Class Action Waiver: To the maximum extent permitted by applicable law, all claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

11. Changes to Terms & Severability

• Updates: We reserve the right to amend or replace these Terms at any time. If a material change occurs, we will notify you within the App or via email prior to the changes taking effect. Your continued use of the Service following any updates constitutes acceptance of the modified Terms.
• Severability: If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full legal force and effect.
